قرارات البلديات ذات الصفة العامة هي علنية، ويحق لكل مواطن الإطلاع عليها
وتنظم المواد ٤٥، ٥٥، ٧٦، من قانون البلديات (المرسوم الإشتراعي رقم ١١٨\١٩٧٧ و تعديلاته) كيفية وصول المواطن(ة) إلى المعلومات في النطاق البلدي
تنص المادة ٤٥ على حق كل ذي مصلحة أن يطلب الإطلاع أو الحصول على نسخة من قرارات البلدية على نفقته ومصدقة من الموظف المختص. ويعتبر صاحب مصلحة كل مواطن يتوجب عليه رسوم بلدية في النطاق البلدي، إن كان ناخباً، أو ساكناً، أو عاملاً. وتنص المادتان ٥٥ و ٧٦ من القانون على وجوب نشر قرارات البلدية النافذة )التشريعية والتنفيذية منها( وذات المنفعة العامة على باب مركز البلدية. تعني هذه المواد أن القرارات ذات الصفة العامة التي تصدر عن البلدية، رئيساً ومجلساً، هي علنية. ولكن في الواقع، نادراً ما يطّلع المواطنون اللبنانيون أو يدرون بمقررات بلدياتهم. فمن جهة، العديد من البلديات لا تلتزم بنشر قراراتها بشكلٍ دوري أو مكتمل، و من جهة أخرى يشكل وجوب التنقل إلى مركز البلدية للاطلاع على القرارات عائقاً أمام ممارسة المواطنين لحقهم الرقابي. وإضافةً إلى ذلك، اختبر عدد من المواطنين الذين قد قصدوا بلديات مختلفة لطلب نسخ عن قراراتها، أنه يتم التحجج بالبيروقراطية لتأجيل تلبية طلباتهم، أحياناً إلى أمد غير محدود

لماذا الشفافية في العمل البلدي؟
تعاني معظم مناطق لبنان من نقص مزمن للتنمية، مع نتائج متفاقمة لهذا النقص. ويظهر جلياً للمراقب أن العمل البلدي في معظم الأحيان يت صّف، أقلّه، بقلّة الإنتاجية وبقصر النظر، وعموماً يأخذ طابعاً خدماتياً استنسابياً متأثراً بوجود المحسوبيات، كما تتخلله حالات فساد تظهر أحياناً في العلن. ونتيجة لذلك أصبح المواطنون غير مؤمنين بالعمل البلدي، وبكفاءة أو نظافة المسؤولين، وتدهورت علاقتهم بهؤلاء و انخفض استعدادهم للمشاركة الفعالة في صنع القرار أو للمساءلة الشعبية. في ظل الوضع القائم، و على ضوء صلاحيات البلديات الواسعة النطاق إذ أن كل عمل ضمن نطاق البلدية له طابع المنفعة العامة هو من اختصاص المجلس البلدي )المادة 47 من قانون البلديات(، تلعب الشفافية دوراً أساسياً لرفع مستوى العمل البلدي، وجعله ينتج سياسات تنموية واضحة، فعالة، ومتوافقة مع تطلعات المواطنين من خلال تمكين هؤلاء من المساءلة الشعبية والمشراكة في صنع القرار
نشر القرارات أونلاين
من منطلق أنّ تأمين البلدية نسخة من قراراتها هو بمثابة حق وخدمة أساسية تقدمها للمواطن، فلا يجوز إخضاع هذه الخدمة إلى روتين إداري غير مبرر بل بالعكس يجب تسهيل حصول المواطنين عليها وبشكلٍ مستمر. من هنا، تعمل الحملة لاستصدار قرارات رسمية صريحة من البلديات تقضي بنشر قراراتها على مواقع الكترونية تتيح للمواطن الوصول إليها دائماً. وعلى وجه الخصوص، لا بد من نشر القرارات المتعلقة بموارد البلدية المالية . كالموازنة العامة و قطع الحساب

التوعية حول الشفافية
تقوم أنظمة الحكم الشفافة على إجراءات واضحة لكيفية صنع القرار، و على قنوات اتصال مفتوحة بين المواطنين و المسؤولين، كما توضع فيها مجموعة واسعة من المعلومات تحت يد المواطنين. وبحسب نقاشات مجموعات مركّزة قامت بها الحملة، تبي نّ أن المواطنين اللبنانيين عموماً غير متمكّنين من مفهوم وأهمية الشفافية في الإدارات العامة و غير ملمين بالآليات التي تعززها أو حتى بحقوقهم التي ينص عليها القانون الدولي كما اللبناني في هذا الخصوص. من حيث أن المواطن هو أكبر مستفيد من نتائج هذه الحملة وهو مصدر ضغط أساسي لدفع البلديات إلى اتباع منهجية شفافة أكثر، تعمل الحملة على توعية الرأي العام حول الشفافية كي يصبح شريكاً في الطلب من البلديات نشر قراراتها
المساءلة القانونية
تؤدي المساءلة دوراً مكملاً لأجهزة الرقابة التي يمارسها عدد من الأجهزة المختصة التابعة للسلطات المركزية والتي تنظر في قانونية القرارات التي تصدر عن البلديات ومدى تطابقها مع القوانين والن ظُم المرعي إجراؤها. أما الشفافية فهي وسيلة لضمان شرعية القرارات التي تصدر عن المجالس البلدية – المنتخبة – وهي مسؤولية تقع على عاتق المواطنين كافةً، بصفتهم مصدر السلطات ومصدر المال العام، وبالتالي فهي تغطي نطاقاً مختلفاً تماماً عن مجال اختصاص أجهزة الرقابة. وهذا النوع الخاص من الرقابة تسمى في القانون الإداري “الرقابة الشعبية” أو “الرقابة المدنية”
الحكم التشاركي
وأبعد من المساءلة الشعبية، إن الشفافية مكو نّ أساسي من الآليات التشاركية في صنع القرار، حيث يشارك المواطنون بشكلٍ ممنهج في عملية صنع القرارات والسياسات العامة، وهي المنهجية الأمثل في العمل للاستجابة لحاجات الناس وهواجسهم ولزيادة شرعية، فعالية واستدامة السياسات العامة، كما للاستفادة من الطاقات والموارد البشرية الموجودة في المجتمعات المحلية

BACKGROUND
The municipal decisions that are of public character are public, and citizens have the right to access the information contained in them.
Articles 45, 55 and 76 of the Municipal Act (Decree-law no. 118/1977 and its amendments) regulate the right of access to information at the municipal level.
Article 45 stipulates that any stakeholder shall be entitled to request a copy of the Municipal Council’s decisions, on his own expenses, authenticated by the competent civil servant. It is understood that each taxpayer in the municipal area is a stakeholder, whether a voter, a resident or a worker.Articles 55 and 76 stipulate that effective public decisions (whether legislative of executive) and decisions of public character shall be posted on the door of the municipality center.
This means that decisions of public character issued by municipalities, whether by the mayor himself or by the municipal council, are public. Unfortunately, Lebanese citizens are rarely aware of the decisions made by their municipality. On one hand, several municipalities refrain from publishing their decisions periodically or in full; on the other hand, the fact that citizens have to be physically present in the municipality center to be informed of those decisions undermines their right to monitor the role of their municipality. Furthermore, several citizens who did go to their municipality, in different Lebanese regions, to request a copy of municipal decisions cited that civil servants used bureaucracy as a pretext to delay fulfilling their requests, at times for an indefinite period.
‘Municipalities under the spotlight’ is a campaign to promote transparency at the municipal level by publishing all municipal decisions online.
OBJECTIVES
The goal of the campaign is to promote transparency at the municipal level so that citizens can hold their representatives accountable for any public or developmental policies implemented in their municipalities.
The specific objectives:
– Calling for of cial decisions by large municipalities to create their own websites and publish all decisions online, especially those nances-related.
– Raising awareness regarding the principle, mechanisms and importance of transparency in municipal work.
IMPORTANCE OF TRANSPARENCY IN MUNICIPAL WORK
Most Lebanese regions suffer from a chronic absence of development, which results in dire living conditions. In fact, municipal work can be described, at best, as short-sighted and low in productivity, with services being delivered on discretionary grounds due to favoritism and cases of corruption sometimes emerging to the surface. As a result, citizens no longer believe in municipal work, or in the ef ciency and integrity of their of cials.Their relation with their municipal representatives has thus deteriorated and they became less willing to participate effectively in decision-making or public accountability initiatives.
Given the current situation, and in the light of the municipal wide-ranging powers – as each work of public character or interest falls with the scope of the Municipal Council’s competence (Article 47 of the Municipal Act) – transparency plays a key role in upscaling the performance of municipal work, and promoting clear and effective development policies that go hand-in-hand with citizens’ aspirations. Indeed, transparency paves the way to public accountability and allows citizens to participate in decision-making.
Publishing decisions online
Given that it is the right of citizens to request copies of municipal decisions, and since this is a basic service which municipalities should be providing, it should not be halted because of an administrative and unjustified routine. Quite the contrary, this service should be facilitated and provided continuously.This is why the campaign is working on securing official and clear decisions from municipalities, by which they commit to publish their decisions online, on websites that citizens can access constantly. In particular, decisions related to the municipality’s financial resources should be published, such as the general budget and end-of-year financial statements.
Raising Awareness on Transparency
Transparent governance systems are based on clear decision-making measures and open channels of communication between citizens and their of cials; they also offer citizens access to a broad range of information. According to focus group discussions conducted by the campaign, Lebanese citizens are, in general, not well informed of the principle and importance of transparency in public administrations.There is also a lack of knowledge of the means enshrined in international and Lebanese laws and regulations to promote transparency and protect their rights.
Given that citizens are the main bene ciaries of this campaign and an essential tool to pressure municipalities into adopting a more transparent methodology, this campaign aims at sensitizing the public on the importance of transparency and engaging citizens in a way that they, too, request that municipalities publish their decisions.
Public Scrutiny
Public scrutiny plays a complementary role to that of the control authorities administered by competent organs at the central level, which verify the legality of municipal decisions and their conformity to applicable rules and regulations. As for scrutiny, it is a means to guarantee the legitimacy of decisions issued by elected municipal councils: a responsibility borne by all citizens, being the source of power and public funds. Thus, it covers a range of areas, which are quite different from the competence of control authorities.This type of control is referred to in the administrative law as “public oversight” or “civil oversight”.
Participatory Governance
Beyond public scrutiny, transparency is an integral part of decision-making participatory mechanisms. It enables citizens to participate systematically in decision-making and public policy processes, which, in itself, is the ultimate method to meet citizens’ needs and address their concerns. It also contributes to strengthening the legality, effectiveness and sustainability of public policies and using the human potential and resources available in local communities.
